Projects with different categories of work cannot be combined unless ancillary in nature.

FEMA reduces the Federal share of eligible cost for alternate projects.

406 mitigation funds cannot be retained on alternate projects or improved projects that involve relocation or facility replacement at the same site.

Sub-recipients agree to a fixed cost estimate and the sub-recipient is allowed to use the excess funds for PA Program-related purposes.

No adjustment to the fixed cost estimate, with the exception of insurance adjustments.

Sub-recipient has flexibility to repair or rebuild a facility as it deems necessary for its operations without any requirement to rebuild to pre-disaster design, capacity or function.

Agreement on the cost of the fixed estimate sub-award must be reached within 12 months of the declaration date. However, it can be extended where construction has not begun under new version of guidance.

No additional DAC will be considered at the sub-award’s closeout.

Sub-recipient can combine two or more fixed estimate sub-awards into a single sub-award. They may also apply funding across any of the facilities within the consolidated sub-award in order to meet its post-disaster recovery needs.

The sub-recipient may consolidate sub-awards from different categories of permanent work (such as, combining Category C and Category E sub-awards) or consolidate within them the same category of work (such as, multiple school-campus sites/locations).

FEMA will not apply this reduction to sub-awards funded under the alternative procedures pilot program. This provision applies only to projects for which the sub- recipient requests alternative procedures for a sub-award based on a fixed estimate.

FEMA may allow for the retention of 406 mitigation funds on a case-by-case basis where prevention of future similar damage is proven to be of greater or equal benefit than that which would have been achieved through the mitigation scope of work in the originally approved repair sub-award.
